About FORAM

Foram joined InfoLawGroup in May 2022 from BakerHostetler LLP’s data privacy group. Foram’s practice focuses on counseling companies on product, business, and compliance strategies with complex and evolving U.S. state laws. She has significant experience working with internal stakeholders – marketing, HR, IT, and engineering teams – to operationalize privacy compliance at scale while meeting business objectives and protecting consumer privacy interests and is adept at translating complex legal requirements into concepts that can be understood and acted upon by business units. She advises on risk mitigation with use of consumer and employee data with loyalty programs, new product offerings, marketing initiatives, and use of emerging technologies.

REPRESENTATIVE Experience

  • Secondee on the privacy legal team at a major technology company in Silicon Valley advising on all matters related to employee privacy including development of internal products and features, readiness for compliance with new state laws, and operationalizing compliance with CA’s CCPA, as amended by CPRA for employment-related data.  

  • Represented several Fortune 500 companies in CCPA investigations brought by the Office of the California Attorney General on issues including sale, notice of financial incentives, discrimination, GPC and use of cookies and online tracking technologies.

  • Counsels clients on GDPR, CCPA, CPRA, CDPA, CPA, CAN-SPAM, CalOPPA, and other state and global law compliance.

  • Significant experience working in-house on secondment to a globally traded tech conglomerate in Silicon Valley to advise on business and legal risks associated with employee privacy in products, processes and policies.

  • Drafts Privacy Policies, service-provider addenda, consumer- and employee-facing disclaimers.

  • Advises clients on employee privacy matters including compliance readiness with CPRA, surveillance, monitoring, and use of artificial intelligence and automated decision making in the employment context.

  • Designs all aspects of privacy compliance programs including reviewing data mapping, scoping compliance requirements, determining strategy related to responding to data-subject requests, internal trainings/checklists, and drafting template responses.

  • Drafts privacy sections of vendor agreements for CCPA and CPRA compliance.

  • Advised a national cable and telecommunications company on operationalizing an Address Confidentiality Program to protect domestic abuse victims.

  • Counseling a range of clients on IP strategy, trademark enforcement, copyright infringement and unfair competition issues.

  • Initiating trademark prosecution and enforcement, including strategizing brand protection, analyzing trademark infringement, drafting cease and desist letters and responding to infringement threats, negotiating settlements and drafting license agreements.
