About DAVE

Dave Radmore is Senior Counsel at ILG, which he joined in 2022 after nearly a decade of in-house experience. Dave advises clients ranging from multi-national Fortune 500 firms to start-ups on data privacy compliance under U.S. state privacy laws and GDPR. He drafts client privacy policies and advises on the implementation of consumer privacy programs, and he has deep, focused experience in workplace privacy, from employee and applicant privacy notices to counseling employers on monitoring practices and the internal uses of employee data.

Dave counsels clients on AI governance and AI contracting. He drafts AI acceptable use policies, governance policies, and governance standards, including provisions for bias auditing and tool testing, and criteria for approving new AI use cases. He negotiates agreements for AI-enabled products and services, drafts AI-specific contract addenda, and advises on the privacy and employment law risks raised by AI tools in hiring and recruiting, including disclosure requirements for recorded interviews used for AI analysis. He has also advised clients on federal preemption questions related to state laws governing AI in employment decisions.

Dave has spent significant time embedded with client legal teams. He has served on extended secondments and ongoing privacy counsel coverage arrangements with a global technology platform and a national entertainment company, working onsite and alongside in-house teams. Beyond day-to-day legal review, that work has included advising on secondary uses of workplace data, such as physical access and badging records collected for security purposes, and on the use of productivity and performance metrics, including code contribution data and time spent on tasks, to inform business decisionmaking. He has also led process improvements for in-house legal workflows, and built reusable contract templates for recurring low-risk use cases so client teams can handle routine agreements without outside counsel.

Dave has significant experience negotiating contracts for clients, with a focus on technology, data privacy and IP issues arising from a range of agreements. Dave drafts and negotiates data protection agreements at volume, including terms addressing cross-border transfers and the EU Standard Contractual Clauses. He negotiates technology agreements including API, software licensing, SaaS, and developer agreements, and digital marketing agreements for services such as consumer review aggregation, marketing performance metrics, and e-commerce point-of-sale solutions. Dave also handles intellectual property licensing for interactive entertainment, negotiating game and franchise license agreements among studios, developers, and distribution platforms, including franchise rights, holdback and approval rights, and amendments across multi-party license structures.

Before joining ILG, Dave spent nearly a decade in-house as privacy counsel to a major California trade association, where he advised an entire industry on its obligations under the California data privacy laws and provided legal advice both internally and to the many small businesses that make up the association’s membership. He built CCPA compliance tools and procedures for members to use in their own businesses, managed the association’s PCI-DSS compliance program, and oversaw the investigation of and response to a data breach.

Dave is a member of the International Association of Privacy Professionals (“IAPP”) and holds both the CIPP/US and AIGP (Artificial Intelligence Governance Professional) certifications.
