As discussed in our earlier post, the size of the monetary penalty against YouTube (a total fine of $170M) is eye-catching, especially compared to the previous high-water mark for COPPA fines ($5.7M). However, more noteworthy is how the FTC concluded that YouTube fell within the scope of COPPA, how this affects operators of other platforms that host substantial user-generated content, and what it might mean for businesses that distribute child-directed content through those platforms.
