Just in from Texas: The Texas' App Store Law Is Back On — For Now

On May 28, the Fifth Circuit stayed a lower court order that enjoined Texas’ App Store Accountability Act. Practically speaking, this means the law is now enforceable. The stay is temporary as the Fifth Circuit will still conduct a full review on whether the district court was right that the law likely violates the First Amendment. The Fifth Circuit’s unpublished opinion offered no explanation for its order. But for now, compliance obligations are live.

As a reminder, this Texas law impacts companies with mobile applications that are distributed through app stores, requiring app stores to verify user ages at the platform level, but also puts obligations on app owners/operators. Stay tuned for more updates from InfoLawGroup.
