Texas App Store Age Law is Enjoined
by: Tatyana Ruderman
Last week, a Texas federal court enjoined the Texas App Store Accountability Act from taking effect as anticipated on January 1. As a reminder, this Texas law impacts companies with mobile applications that are distributed through app stores as it requires app stores to verify user ages at the platform level, but also puts obligations on app owners/operators. The challengers alleged that the law unlawfully restricts free speech under the First Amendment, and the federal court held the law was not sufficiently narrowly tailored under the strict scrutiny standard. While this Texas law is enjoined, similar laws are set to take effect in other states, including in Utah (May 2026), Louisiana (July 2026), and California (January 2027), but may yet face challenges on similar constitutional grounds.
